>> i have to admit i voted for that. it was against the principles i believed in. when you are part of the team, sometimes you take one for the team as a leader and i made a mistake. >> greg: well, he less batman and more robin. one thing is missing, obama. the only thing that could add a new spark to the field of candidates. the chance to square off directly against the one guy who would make any of them look good. with unemployment near 9%, real unemployment god knows where. rising gas prices, dead keystone pipeline and eric holder still about somewhere. the republicans need to get one guy in front of obama and go head-to-head. he is their secret weapon. tepid sitcom. have the group hug like starting episode of "mash," take the starting q.b. and get the playoff. even tom brady could win this one. the american public must choose two, or the prom date will never get the tux in time. it was in '87.

i had to wear my mother's house coat with a golf bag over it. >> dana: so weird. don't have a picture of that? >> greg: i do have pictures. what did you make of the debate? did you watch it? >> kimberly: i did. i was hoping it was more exciting. it was on another network. we took sloppy seconds. but i thought he did okay. newt came back a little stronger, which i like. >> greg: a lot of mixed metaphors in there. i won't touch. bob, where did santorum end up? this? >> bob: well, first of all, let me just say the american people won. that is the last one of these things they have to put themselves through. santorum, look, santorum had his moment. he wasn't up for it. obviously. romney wins this debate, by default almost.

but he loses in the general election, because he puts himself so far to the right. yeah, he beat rick santorum. he will win michigan, and he will win, i think arizona. he will probably put the guys away. it was a storm, man. your idea -- first, it's closer to 8%, not 9%. you think against obama any of the bums will stand up? >> greg: all they have to do is get in room with them. >> bob: get out of here. newt has a better chance. >> dana: that would be fantastic to watch. >> bob: romney won by default. that's too bad. >> greg: eric, do you think that, did anything occur to you that was positive? i saw a few moments. >> eric: before i get into that, kim is delectable, bob is tough guy and dana is america's snow global and i'm swamp thing? >> greg: right wing swamp thing. superhero that lived in a swamp. my impression of the debate is

four guys trying to figure out where they are. i expected newt gingrich to be tougher on everyone. he backed off. ron paul -- a lot of guys played nice. i didn't love it. but it did strike me as look, it may come down to romney is the guy, santorum might be the guy. either two. but they are not going to win in 2012. obama is going to lose in 2012. so really, for me, it doesn't matter which one goes of the two. still g.o.p. in 1600. >> dana: like if you had a salad mixer thing and you could take the economic abilities of mitt romney, his experience and the social conservatism with the debate skills of newt gingrich which are amazing and ron paul still has -- we don't talk about him enough. he has enthusiastic base. if you mix them together, the american g.o.p. public might say that is the guy we want. did say that anybody who thinks that romney would not

take on obama in a debate, he eviscerateed rick santorum. >> bob: that is eviscerating rick santorum. the history of the american politics is littered with the bodies of people who tried to beat an incumbent president because he had to lose. that is the problem. this race, obama has to lose it. $4 gasoline, the economy gets bad, whatever. but they have nothing to take to the public, except for they're not obama. it may be enough. but it's rare it happens. >> eric: $4 gas by that time. 9% unemployment. it will be enough. >> bob: do you think the munchkins are up to this? >> dana: absolutely. >> eric: i don't think it matters who it is. 8.5% unemployment and $4 for gas, america will say i'm done. not four more years. i think ron paul could beat -- >> bob: do you think ron paul could beat obama? >> eric: you pick that one.

>> greg: ron paul is the most comfortable person on the stage. >> you're a libertarian. >> greg: comfortable in his own skin. i hate using that cliche. >> dana: last night, i thought ron paul and the gingrich as bookends were interesting. if you look at the body language and posture, gingrich sat there the whole night like this. >> greg: yeah. a guy at a bar trying to pick up women. sitting here hanging out. >> bob: he didn't want to be seen as the nasty mean guy. >> i had a problem with the debate. the $64 billion-pound gorilla in the room is gas prices. he didn't even ask it. so unbelievable. unfair. >> greg: national review posted an editorial, excellent question. why should conservative trust the choice of their candidate with the mainstream media?

have you struggled to sleep at night? >> greg: it always seems like they're more like dissec dissecting a frog. less interested in debate than taking apart conservative ideas than mocking them. >> dana: that is a big election top nick a way. liberal bias in the media, does it except and how bad is it? a few years ago the candidates had a right to say we'll refer to the rnc, republican national committee and let them decide what debates we'll do. they couldn't come to an agreement. instead, cnn will call you, say do you want to do a debate? call you, santorum is going to do the debate, are you doing the debate? they find themselves over and over every night in the situation. >> one or two of the questions may have been off the wall. but they were legitimate questions. the contraception question was not brought up by the media, it was people attacking obama

well, 55% of americans paid any income tax to the federal government. we'll get into this. and discuss it. because there is a lot of angles. how did we get here in the first place? take a listen to what president obama has been telling us the hast couple of years. >> everyone gets a fair shot and does their fair share and plays by the same set of rules. americans who afford it should pay their fair share. it makes sense for those of us who have done best to do our fair share. the american values of fai fairness. of fairness and responsibility. we expect everyone to do their fair share. everyone is doing their fair share, everyone engages in fair play. everybody does their fair share. build an economy everybody gets a fair shot and does their fair share and takes responsibility. everyone is playing by the same set of rules.

>> dana: now we have an election year debate, how much do we have and how are we going pay for it? how many taxes? i think we should add in how should we wholesale reform the tax system. do you think when people think that this statistic, 55% of americans only ones paying income taxes, it's a mess? >> greg: break it down. there are people paying payroll taxes. 18% of people who don't pay any taxes. i'm not interested in demonizing people who don't pay taxes. i'm interested in stopping the demonization of people who pay most of the taxes. i think that is what we're talk about. the car warfare rhetoric. some people don't pay taxes. i get it. i'm a conservative, i don't want to pay taxes. i have a solution. fair share tax. anytime someone in the media says fair share they are taxed $5. in a week the democratic party

make less than people taking. makers make less than takers. that gets to be 50% of the people because they vote. if it exceeds 50% it will guess worse and worse. the makers won't keep it with it. they pay 90% of tax. >> bob: 87 and 90 is not far apart, is it? just because people take legitimate tax deductions, and every president including george bush did the tax deduction added people who didn't have to pay taxes. that was the right thing to do. why should they pay the taxes? >> eric: we can solve the problem. forget flat tax or income tax, go to fair tax. tax stuff you buy. it doesn't matter what you make or don't make, who you are. >> dana: there is a way to do that to give a credit to people of lower incomes, so

basically they are getting more to afford sales tax. >> kimberly: it's built in. everybody agrees, virtue that bob agrees with this and says we should explore a wholesale reform of the tax system. it's not working. sorry, bob, but with the current administration, we're spending more than taking in. this is a huge problem. you don't have to be a rocket scientist to figure it out. it would be equitable if everybody pays their fair share. >> eric: the wayer -- >> bob: the way eric throws it around, exact same number of people didn't pay under george bush. people didn't complain about it then. >> dana: they did complain about it. child tax credit issue is a double-edge sword. the child tax credit is meant to help families. what it did is it took people off of having to pay that rate of the income tax.

i'm bret baier in washington. the big story is the energy policy speech and what he thinks are the chances in the fall election. tonight on "special report," the president let it slip how confident he is in winning in november. ed henry has that story and details of the president's remarks in miami about gasoline prices. the men aiming at trying to kick the president out of the white house are preparing for a crucial stretch, more than 500 convention delegates are at stake in an eight-day period that begins next tuesday.

story and show the atrocities. that is one of the great things about journallism. the power that a free media can bring to an issue, an attention. i remember mike mccurry, president clinton's press secretary saying the same time that everything was happening in serbia, if they had had more information on the front page of the "new york times" every day about rwanda, they might have been able to step in and do something sooner. the western world seems hogtied when it comes to syria. >> bob: the problem, what kind of people, you know, kills christians and riot over a burned book? >> greg: they kill each or. it's not about two different worlds. he's about two different eras. we are in the 21st century and dealing with people in the sixth century. it's almost an impossible -- we are at a bell curve where we have reached a point. they are still way back here.

♪ ♪ >> kimberly: welcome back to "the five." the supreme court is said to take up a controversial case in the fall. this is just before the nevada election. this case came to the court after a white student was denied admission to the university of texas. this is a huge case. the law is based on 2003 case that justice sandra day o'connor wrote the opinion on that set up the guideline for everything for affirmative action. this is a direct play against it. which could change the way

applicants admit ones they use. >> greg: i wish i read the article. the first group is the top 10% of the class. the rest, they factor in race. it's not the diversity of the college campus but spreading the students out once they're there, so it's like creating the, creating even balance when there really doesn't need to be. the problem with affirmative action it forces people to college they may not be prepared to go to, so they drop out at a higher rate. it's much better to match a school to your test score and succeed there and perhaps move from that college to another college. go to junior college. >> bob: i got in a lot of colleges. not because of the test scores. >> kimberly: how did you get in? >> bob: football. did they say that, what are the rules specifically? >> kimberly: you can use this as a criteria. >> bob: you can use it?

>> kimberly: yes. in 2003. in the fifth circuit, guess who got involved to stop it from getting to the u.s. supreme court? the obama administration. wrote a brief on behalf and now it's -- >> bob: what is the arguement? >> kimberly: he is had better grades an minority applicants and were given advantage through affirmative action. critics say there seems to be a need for this before. if you look at the demographics of who in fact is enrolled in school and you compare it with the different ath necessity, white population, et cetera, african-americans, latinos it's disproportionate. you have more white and less per the number enrolled -- >> bob: blacks were denied admission to white universities in the beginning of the country. why not balance the scale up? >> kimberly: but at what point have we overcompensated where now you discriminate against a different group? that is a question. >> greg: what about the point i made earlier if you get them to colleges they're not prepared for, they have a tendency to drop out higher.

>> bob: is that true? >> greg: yes. >> kimberly: is that from a institute? >> greg: gutfeld institute of affirmative action studies. >> bob: do you know it's accurate statement? >> dana: i haven't been to the giaas site lately. but you don't get what you pay for at the colleges. if these were businesses and the end product, you would not buy it. you'd say i'm not buying that. >> eric: there are predominantly black colleges as well. if diversity is the real issue, should shay have diversity? >> bob: to concept was to make up for hundreds of years of ills.

>> kimberly: we get it but when do you stop? >> greg: you never stop. that is the thing. you are eternally guilty. >> kimberly: i'm not. >> eric: you are guilty. >> bob: i understand why it riles people but people who are silent there were years blacks were denied access to construction jobs and college and everything. that's why we have it. >> dana: good news, in the private sector, bosses, ceos and the like recognize diversity is good for the company. so they look for diverse college. if you take the top 10% it accounts for 57% of admission. that was increasing enrollment. the debate continues at another time. >> greg: it won't. >> kimberly: yes, it will.
